This Privacy Policy explains how CC SCOA III, L.P., doing business as The Highlands, which develops and operates the master-planned community (“The Highlands,” “we,” “us,” or “our”), collects, uses, shares, and protects personal information in connection with our website, online services, forms, events, and other online interactions with us. Please read it together with any notice we give you at the time you provide your information. In this policy, “affiliates” means companies that control, are controlled by, or are under common control with The Highlands, including other Caldwell homebuilding, real estate, and community development entities.
Our Affiliates
The Highlands is part of a family of affiliated companies. We and our affiliates may share the information described in this policy among ourselves and use it for the purposes described here, including to keep you informed about homes, communities, products, and services across our affiliated companies. This sharing is subject to any specific limits stated in this policy, such as the limits on mobile opt-in information described under “Text messages.”
When one of our affiliates collects your information directly, through its own website or at one of its communities, that affiliate is responsible for the information it collects and may provide its own privacy notice. This Privacy Policy governs personal information that The Highlands collects through the channels described above.
Our Builder Partners
The Highlands is a master-planned community. Homes and homesites in the community are built and sold by independent homebuilders that participate in the community (“builder partners”). When you request information about homes or homesites, or ask us to help you find a home in the community, we may share your contact information and your home and community preferences with one or more of our builder partners so they can follow up with you about available homes and homesites.
Our builder partners are independent companies and are not affiliates of The Highlands. Once we share your information with a builder partner, that builder partner uses your information under its own privacy policy. Under some laws, including Texas law, this sharing may be considered a sale of personal information. You can opt out of our sharing your information with builder partners as described in “Your Privacy Rights.”
Information We Collect
Information you provide
When you contact us, register on our site, request information, schedule a visit, or take part in a survey, contest, or event, we may collect your name, email address, phone number, mailing address, ZIP code, and your home and community preferences.
Information collected automatically
When you use our site, we and our service providers may collect your IP address, browser and device information, the pages you view, the website that referred you, campaign or UTM parameters, and information from cookies and analytics tools.
We do not ask for or store information about your household composition, marital or family status, income, or similar characteristics on this site.
How We Use Your Information
We use your information to respond to your inquiries; provide information about the community, homes, homesites, and events; schedule visits; register you for events; share your information with our builder partners so they can contact you about homes in the community; send marketing communications you have requested; personalize our communications with you; operate and improve our website; maintain our customer relationship management system; measure the effectiveness of our marketing; and meet our legal obligations.
Cookies, Analytics, and Advertising
Our website uses cookies, pixels, web beacons, and similar technologies to operate the site, remember your preferences, understand how the site is used, and measure and support our marketing. We work with analytics and advertising platforms, including Google and Meta, for these purposes. Some of this activity involves showing you The Highlands ads on other websites and platforms based on your activity over time, which is known as targeted advertising. We do not use race, color, religion, sex, disability, familial status, national origin, or other protected characteristics to target housing advertising.
Your Advertising Choices
You can limit or opt out of targeted advertising in several ways:
- Adjust your browser settings to block or delete cookies. Some features of our site may not work as well if you do.

Marketing Communications
If you opt in, we may send you marketing emails. You can unsubscribe at any time using the unsubscribe link in any marketing email or by contacting us. Consent is not a condition of purchasing any home or service.
Text messages
If you opt in, we may send you text messages about the community, homes, events, appointments, and follow-up communications. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchasing any home or service.
Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. If you wish to be removed from receiving future communications, you can opt out by texting “STOP.”
How We Share Information
We may share personal information with our affiliates, as described in “Our Affiliates” above; with our builder partners, as described in “Our Builder Partners” above; with service providers that perform functions on our behalf, such as website hosting, our customer relationship management platform, and analytics and advertising partners; with marketing or event partners under contract; when required by law or to respond to legal process; to protect the rights, safety, or property of The Highlands or others; and in connection with a merger, acquisition, or sale of assets.
We do not sell your personal information for money. We do share your information with our builder partners and with advertising and analytics partners, including Google and Meta, as described in this policy. Under some laws, including Texas law, this sharing may be considered a sale of personal information or targeted advertising. You can opt out as described in “Your Advertising Choices” above and “Your Privacy Rights” below.
Data Retention
We keep personal information for as long as needed to fulfill the purposes described in this policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we take reasonable steps to securely delete or de-identify it.
Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping confidential any passwords or credentials you use with our services.
Your Privacy Rights
If you are a Texas resident, you have the following rights (and residents of some other states may have similar rights):

We will need to verify your identity before acting on your request and may ask for information to match against our records. We will respond within 45 days of receiving your request and may extend that period by an additional 45 days when reasonably necessary, in which case we will notify you.

If we decline to act on your request, we will tell you why. You may appeal that decision by contacting us using the contact information below. If we deny your appeal, you may submit a complaint to the Office of the Texas Attorney General [texasattorneygeneral.gov].
No retaliation
We will not deny you goods or services, charge you a different price, or provide you a different level of service because you exercised your privacy rights.
Children’s Privacy
Our website is directed to adults who are interested in our community and homes. It is not intended for anyone under 18, and we do not knowingly collect personal information from children under 13, consistent with the Children’s Online Privacy Protection Act. If you believe a child under 13 has provided us personal information, please contact us and we will delete it.
Third-Party Websites
Our website may link to websites we do not control, including the websites of our builder partners. We are not responsible for the privacy practices of those websites, and we encourage you to review their privacy policies.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the Effective Date above and post the updated policy on our website. Your continued use of our website after we post changes means you accept the updated policy.
